Richard M. Schall, a partner in the law firm of Schall & Barasch L.L.C., devotes his legal practice to representing individual plaintiffs in employment rights litigation, including cases arising under the federal and state laws against discrimination, the Americans with Disabilities Act, the Family and Medical Leave Act, the state Conscientious Employee Protection Act and state contract law.

Mr. Schall has successfully litigated complex employment cases in the state and federal courts and has negotiated successful settlements in more than 100 cases on behalf of his clients. He and his partner Patricia Barasch were the attorneys in the case of Maw v. Advanced Clinical Communications, Inc., which went to the NJ Supreme Court, challenging the right of employers to fire employees who refuse to sign an overbroad non compete agreement.

Mr. Schall is a graduate of the Trial Lawyers' College, an intensive three-week training program for trial lawyers conducted by the renowned trial lawyer, Gerry Spence, on his ranch in Wyoming. He was one of only 50 lawyers from around the country selected for the 2003 College.

Mr. Schall is listed in The Best Lawyers in America and has been named among New Jersey’s "Super Lawyers" by New Jersey Monthly Magazine in the area of employment litigation for three consecutive years from 2005-2007.

An advocate of voluntary Alternative Dispute Resolution, Mr. Schall was recently admitted to the State of New Jersey Roster of Mediators for Civil, General Equity and Probate Cases. In his capacity as mediator, Mr. Schall assists parties in resolving their disputes without the need for protracted litigation.

Prior to forming Schall & Barasch L.L.C., Mr. Schall spent over eleven years with the law firm of Tomar, Simonoff, Adourian, O'Brien, Kaplan, Jacoby & Graziano and was a shareholder for his last four years with that firm, heading the firm's employment law practice. From 1990 through 1994, he taught legal research and writing as an adjunct professor at Rutgers University School of Law. In 1995, he taught Introduction to Labor Law at Rutgers. Before joining Tomar, Simonoff, Mr. Schall served a one-year clerkship with The Honorable Dolores K. Sloviter of the United States Court of Appeals for the Third Circuit. He graduated from the New York University School of Law in 1987, received a Master's Degree in Labor Studies from Rutgers University in 1984, and graduated with a Bachelor's Degree in 1971 from Swarthmore College, with a major in philosophy.

Mr. Schall has served for the last four years as President of the National Employment Lawyers Association/New Jersey (NELA/NJ), the state-wide organization of plaintiffs' employment lawyers. In addition, Mr. Schall is an author of numerous articles and is a frequent speaker within New Jersey and around the country on issues concerning the rights of employees in the workplace. He has written for and addressed conferences of NELA, the Practicing Law Institute (PLI), and the Association of Trial Lawyers of America/New Jersey (ATLA-NJ). For three consecutive years, Mr. Schall has served as co-chair for the Employment Law Seminar conducted by ATLA-NJ, held as part of its Boardwalk Seminar in Atlantic City.
